The products must be returned to us in their original condition and packaging. Particular attention must be paid to the packaging to avoid breakage. Return the package with the delivery note and this document "Returns and Refunds".

You must write and sign a document with the information of the products you wish to return.

You must proceed in parallel to this return, to a computerized request for return which will allow you to be refunded.

 Here is the procedure to follow to make the request for return:

- Click on "Make a return"

- Notify the reason for the return under each reference.


A refund will be made to the payment method used at the time of your order, within 14 days after receipt of your return package/returned products.

GENERAL SALES CONDITIONS


Definition:

By "Customer": it is necessary to understand the major physical persons having the legal capacity to contract placing order on the Site.

"Products" means all products offered for sale on the merchant website www.lesenfantsdurhone.boutique on the French territory.

By "Site": it means the Internet site www.lesenfantsdurhone.boutique operated by the company WINE FOR BREAKFAST.

"Order" means the sales contract concluded between WINE FOR BREAKFAST and the Customer concerning the Products offered on the Site.

By "WINE FOR BREAKFAST" : a limited liability company with a capital of 5 000 €, located at 8 rue des mariniers 69420 Condrieu, registered at the RCS of LYON under the SIREN number 897936720, intra-community VAT number FR86897936720. 



ARTICLE 1: APPLICATION, ENFORCEABILITY OF THE GENERAL CONDITIONS OF SALE


The present general terms and conditions of sale (GTC/CGV) apply to all sales concluded by WINE FOR BREAKFAST with consumers and non-professional buyers ("The Customers or the Customer"), wishing to acquire the products offered for sale ("The Products") via the website www.lesenfantsdurhone.boutique.

In these capacities, he has specific rights, notably detailed in the Consumer Code. Consequently, the provisions of the GTC do not apply to professionals. WINE FOR BREAKFAST reserves the right to refuse or cancel any order from a customer who proves to be a professional and in particular a professional reseller.

The Customer declares having the legal capacity to contract.


ARTICLE 2: CREATION OF PERSONAL ACCOUNT

 

n order to place an order on the Site, the User must create a personal account on the Site, according to the terms and conditions specified in the general terms of use of the Site.

ARTICLE 3 : ORDER PROCESSING

 

3.1 The Customer places an order according to the process in force on the Site and confirms the summary of the order.

They must select the Product(s) chosen and the desired quantity, which are visible in the "My Cart" section.

 


3.2 The order will be the subject of a summary called "My Cart", which can be consulted at any time and which includes all the elements of the order, in particular the Product(s), quantities, unit price, possible discounts, method of payment, method of delivery, and the total amount of the order including delivery costs.


The sales contract is validly formed when, after entering his/her email address and password, the Customer has placed his/her order (1st click), has been able to read and accept the GTC, has checked the content of his/her order (all the Products he/she wishes to purchase and the price), has corrected any errors and has confirmed it by a second click, in accordance with the provisions of articles 1125 to 1127-3 of the Civil Code.


In the absence of acceptance of the GTC (CGV), the Customer will not be able to finalize his order.

Any order form signed by the validation click constitutes a firm and irrevocable commitment of the customer which can be questioned only in the cases restrictively envisaged by the law in the article 16 "Right of retractation".

In accordance with Article L221-14 of the Consumer Code, any order confirmed by the second click involves an obligation to pay.


ARTICLE 4: ORDER CONFIRMATION


The Customer will receive by e-mail from LES ENFANTS DU RHÔNE, an acknowledgement of receipt confirming the order and the corresponding invoice (Customer's address, delivery address, Products ordered, price, method of payment, delivery charges) and the cancellation form.

In the event that an order is not available within the time limit specified on the Website, the order will be cancelled and LES ENFANTS DU RHÔNE will immediately reimburse the Customer.


ARTICLE 5: CUSTOMER INFORMATION


5.1 The offers contained on the Site are valid as long as the related Products remain online and in stock. The availability of the Products is specified in real time on the Product sheet. The unavailability of the Product may restrict the choice of collection and/or delivery of the Products.

5.2 Each Product is the subject of a photo and a description on the product sheet which includes the essential characteristics of the Product and possibly the specific information and mentions imposed by the law. WINE FOR BREAKFAST takes its best care to provide photographs and descriptions of the Products as accurate as possible.

The Customer is required to refer to the description of each Product in order to know its properties and essential characteristics.

The Customer acknowledges having been informed, prior to placing his/her order, in a legible and comprehensible manner, of the present general conditions of sale, of all the information and details referred to in Article L.221-5 of the Consumer Code, and in particular

- the essential characteristics of the Product, taking into account the communication medium used and the Product concerned

- the price of the Products and related costs (e.g. delivery)

- in the absence of immediate execution of the contract, the date or the deadline by which WINE FOR BREAKFAST commits to deliver or make available the Product

- information about the identity of WINE FOR BREAKFAST, its postal, telephone and electronic contact details, and its activities, if not apparent from the context

- information about the legal and contractual guarantees and their implementation modalities

- the possibility of resorting to conventional mediation in the event of a dispute

- information on the right of withdrawal (existence, conditions, deadline, procedures for exercising this right and standard withdrawal form), the cost of returning the Products, cancellation procedures and other important contractual conditions



ARTICLE 6: FEES AND PAYMENT METHODS

 

6.1 Prices are expressed in euros, all taxes included. The price guaranteed to the Customer is the one appearing on the Site at the time of the order. The price is firm and definitive.

In addition to the price of the Product, the Customer will have to pay on the one hand the delivery costs which vary according to the delivery or collection method chosen, the volume and weight of the parcel and on the other hand, any processing costs indicated before the validation of the order by the Customer, during the summary of the basket (second click).

 

6.2 An invoice will be sent to the Customer by email, on the email address provided by the Customer, at the time of the order confirmation.

The Customer pays his order by credit card or by Paypal. During the validation of the order, a pre-authorization will be made on the Customer's credit card. Depending on the delivery method chosen by the Customer, the amount will be debited :

- Either when the order is shipped for a home delivery or in a relay point;

- Or when the order is complete and ready to be picked up by the Customer in the case of a "click 'n collect" order.


6.3 For the security of payments, WINE FOR BREAKFAST uses "Stripe" and "Monetici" which guarantees the security of payments. When the Customer places an order by credit card payment, the order taking system connects in real time with the Stripe or Monetico system which collects the data and proceeds to various verifications to avoid abuse and fraud. The data are stored on Stripe's servers or on Monetico's servers and are not transmitted to WINE FOR BREAKFAST at any time. Stripe or Monetico makes the authorization request to the bank and sends a transaction number to WINE FOR BREAKFAST which allows operations up to the amount of the authorization.

6.4 Any promotional codes communicated to the Customer will only be usable once for the same postal address and the same first and last name.

LES ENFANTS DU RHÔNE BAR À VIN participates in the Click 'n Collect system. This method of delivery is free. This method of delivery allows the collection of the Product(s) ordered within a few hours on the day of the order provided that the order is placed within the order preparation hours set by the store, or the next business day if the order is placed after the order preparation hours set by the store chosen by the Customer and provided that the Product is available in the store. The Customer will be informed if the store is closed.

Orders are usually prepared within a few hours of receipt of payment, unless the store is closed (please check our hours), or during lunch services (Friday and Saturday for lunch and dinner). Please indicate at the time of payment the desired pick-up time and day, or call us directly if you need to prepare an order quickly.

Additional costs

A preparation and handling fee will be applied to any order of more than 6 bottles (2€ extra for each six bottles).

 

Cancellation and refund

All orders that are not collected from the store within two weeks will be cancelled and refunded.

 

 

 

A fee of 5% of the total amount of your order will be applied to all cancelled orders over 100,00€.

ARTICLE 8: GUARANTEES


The Products offered by WINE FOR BREAKFAST comply with the applicable French legislation and standards.

WINE FOR BREAKFAST guarantees that the Products are in conformity with the descriptions appearing on the Site and on the description which is made on the order form.

The Products sold by WINE FOR BREAKFAST benefit by right and without additional payment, in accordance with the legal provisions of the hidden defects (articles 1641 and following of the Civil Code) and of the legal guarantee of conformity (articles L217-4 to L217-13 of the Consumer Code), for the damaged Products or not corresponding to the order.

Article L217-4 of the Consumer Code

The Seller is obliged to deliver goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery. He is also responsible for defects in conformity resulting from the packaging, the assembly instructions or the installation when the latter has been put at his charge by the contract or has been carried out under his responsibility.

 

Article L217-5 of the Consumer Code

To be in conformity with the contract, the product must :

- Be fit for the purpose usually expected of similar goods and, if applicable :

- correspond to the description given by the Seller and possess the qualities that the Seller has presented to the buyer in the form of a sample or model

- have the qualities that a buyer may legitimately expect in view of the public statements made by the Seller, the producer or his representative, particularly in advertising or labelling

- Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the Seller and accepted by the latter.

 

Article L217-12 of the Consumer Code

The action resulting from the defect of conformity is prescribed by two years as from the delivery of the good.

 

Article L217-16 of the Consumer Code

When the buyer asks the Seller, during the course of the commercial warranty granted to him at the time of the acquisition or repair of a movable good, for a repair covered by the warranty, any period of immobilization of at least seven days shall be added to the duration of the warranty that remained to run. This period shall run from the date of the buyer's request for intervention or from the time the item in question is made available for repair, if this is after the request for intervention.

 

Article 1641 of the Civil Code

The Seller is bound by the warranty for hidden defects of the thing sold which make it unfit for the purpose for which it was intended, or which so diminish this use, that the buyer would not have acquired it, or would have given only a lower price, if he had known them.

 

Article 1648 paragraph 1 of the Civil Code

The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.

In order to assert his rights under the warranty, the Customer will have the choice :

- To send back the product: the Customer shall send an email to WINE FOR BREAKFAST at boutique@lesenfantsdurhone.com, clearly expressing his will to invoke the warranty, specifying the defect and bringing any useful proof, the order number and his purchase invoice. WINE FOR BREAKFAST will send him by e-mail a return form to be printed that he will have to stick on his parcel and give it in a post office.

- To return the Product to one of the LES ENFANTS DU RHÔNE BAR À VIN stores of his choice: the Customer will have to come with the product, the order number and the purchase invoice, then fill in the return form.


The Product must be returned in the state in which it was received with all the elements (accessories, packaging,...), using the return slip.

Given the nature of the Products, WINE FOR BREAKFAST undertakes to reimburse the Products under warranty that are found to be non-conforming or defective at the Customer's choice, without any cost to the Customer.

 
The refund of the missing or defective Product will be made as soon as possible after WINE FOR BREAKFAST has established the lack of conformity or the hidden defect.


The refund will be made by crediting the Customer's bank account.


The guarantee of WINE FOR BREAKFAST is, in any case, limited to the reimbursement of the Products that do not conform or are affected by a defect.

WINE FOR BREAKFAST shall not be held responsible in the following cases

- in case of misuse, negligence or shock on the part of the Customer, accident or force majeure;

- denaturation or natural degradation of the Product.

- Storage conditions not in accordance with the nature of the Products.



SECTION 9: PRODUCT WARNINGS

 

The sale of alcohol is forbidden to people under 18 years old. Therefore, by filling out the order form, the Customer acknowledges having the legal capacity to contract.

 

It is reminded that "ALCOHOL ABUSE IS DANGEROUS FOR HEALTH, TO BE CONSUMED WITH MODERATION".

 

Similarly, the consumption of alcohol is not recommended for pregnant women, even in small quantities.



ARTICLE 10: PROOF

 

The computerized registers, kept in the computer systems of WINE FOR BREAKFAST in reasonable security conditions will be considered as the proof of communication, orders and payments between the parties.

The archiving of orders and invoices is made on a reliable and durable support that can be produced as proof.



ARTICLE 11: RETENTION OF TITLE

 

WINE FOR BREAKFAST will keep the property of the delivered Products until full payment of the price, the payment being understood by the effective collection of this price and not by the delivery of a title creating an obligation to pay.

However, the transfer of risks takes place upon receipt of the Products. Indeed, during the entire period of retention of title, the Customer as custodian of the goods is responsible for any damage or loss occurring after delivery and Click 'n Collect. Likewise, the Customer shall be liable for any poor condition of the Product that renders it unfit for use.



ARTICLE 12: PERSONAL INFORMATION

To remedy the proliferation of unwanted telephone canvassing by consumers, the Hamon law on consumption of March 17, 2014 created in the consumer code a list of opposition to telephone canvassing. Consumers will be able to register for free on this list: www.bloctel.gouv.fr. WINE FOR BREAKFAST, like any professional is prohibited from canvassing customers registered on this list, unless they are prior customers. The law prohibits the sale or rental of files containing the telephone and contact information of consumers registered on an opposition list.


ARTICLE 13: APPLICABLE LAW - JURISDICTION

 

In case of dispute, the Customer must contact in priority the customer service of WINE FOR BREAKFAST at 09 85 21 11 22 (non surcharged number from a fixed line in France), from Tuesday to Thursday from 2:00 pm to 5:00 pm or Friday to Saturday from 10:00 am to 5:00 pm except bank holidays or non-working days, or by mail at 8 rue des mariniers 69420 Condrieu.

 

In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, WINE FOR BREAKFAST adheres to the Service of the E-commerce Mediator of the FEVAD (Federation of E-commerce and Distance Selling) whose coordinates are the following: 60 Rue La Boétie - 75008 Paris - www.mediateurfevad.fr. After prior written request from the consumers to WINE FOR BREAKFAST, the Mediator's Service can be contacted for any consumer dispute whose settlement would not have been successful. In the absence of an amicable agreement, the disputes to which the purchase and sale operations concluded in application of the present general terms of sale could give rise, concerning their validity, their interpretation, their execution, their termination, their consequences and their consequences and which could not be resolved between WINE FOR BREAKFAST and the Customer will be submitted to the competent courts according to the provisions of common law.

 

ARTICLE 14: RIGHT OF WITHDRAWAL

 

In the case of a contract concluded at a distance, the Customer who is a consumer or non-professional has a right of withdrawal within 14 clear days from receipt of the last Product "i.e. when the Customer takes possession of the Product or a third party other than the carrier", in accordance with Article L 221-18 of the Consumer Code.

If this period expires on a Saturday, a Sunday or a holiday, it is extended to the next working day.

The Customer shall inform WINE FOR BREAKFAST of his intention to withdraw from the contract by specifying his order number, by means of an unambiguous statement or by means of the form provided at the end of these GTC, by e-mail to boutique@lesenfantsdurhone.com or by registered letter with acknowledgement of receipt addressed to WINE FOR BREAKFAST. The Customer may inform WINE FOR BREAKFAST of his intention to withdraw from the contract by using the withdrawal form available at the end of these general terms and conditions. In case of sending by e-mail, WINE FOR BREAKFAST will send without delay an acknowledgement of receipt of the withdrawal by e-mail.

 

This right of withdrawal is exercised without penalty. The Customer shall return the Products subject to the retraction, at his choice :

- Either by dropping them off at the store at the following address: 8 rue des mariniers 69420 Condrieu

 

- Or by mail the return address is as follows:

In this case the return costs will be charged to the Customer. The shipping costs will depend on the nature and weight of the package.

Only returned products will be refunded.

The Product must be returned in its original condition and packaging. It must not have been used, nor have suffered any deterioration, however slight, and be in perfect condition. Any unpackaged or damaged Product may result in the Customer's liability being incurred. Any Product that has been opened, used, scratched, damaged or that would be incomplete, damaged, damaged and / or whose packaging would have been damaged or that would no longer be suitable for a new sale will not be returned, exchanged or refunded.

Within a maximum of fourteen (14) days from the return of the Product(s) by WINE FOR BREAKFAST, the Customer will be refunded the payments received. The refund, without any additional cost, will be made by the same payment method that the Customer used for the initial transaction, unless the Customer agrees to a different method.

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal is excluded for contracts:

"2° Of supply of goods or services whose price depends on fluctuations on the financial market beyond the control of the professional and likely to occur during the withdrawal period ;

 

4° The supply of goods which are likely to deteriorate or expire rapidly;

 

5. the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection

 

6. The supply of goods which, after delivery and by their nature, are inseparably mixed with other articles;

 

7. the supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed upon at the conclusion of the contract depends on fluctuations in the market beyond the control of the trader;"
